These Terms of Service ("Terms") govern your use of HeyFriend (the "App"), operated by Jex Global Inc. ("we," "us," or "our"). By downloading, installing, or using HeyFriend, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Description of service

HeyFriend is an iPhone app that lets young children participate in pretend "video calls" with friendly fictional characters powered by speech-to-text, generative AI, and text-to-speech. The App is intended for children approximately ages 2–5, used under the setup and supervision of a parent or legal guardian.

HeyFriend is entertainment software. The characters are fictional and are not real people. The replies are generated by AI and are not medical, educational, or therapeutic advice. See Section 8.

2. Who may use HeyFriend

HeyFriend is designed for children, but the App must be installed, configured, and supervised by a parent or legal guardian who is at least 18 years of age. You represent that you are 18 or older and have legal authority to consent to these Terms on behalf of any child who uses the App.

If you are under 18, you may not download or install the App without your parent or legal guardian's involvement.

3. Accounts & setup

• The parent creates a child profile (first name, age, interests, learning goals) stored on the device.
• The parent sets a PIN that gates Settings, in-app purchases, sign-out, and data deletion.
• Optionally, the parent can Sign In with Apple to restore purchases on another device.
• The child does not create an account. There is no public profile, chat with other users, or social feed.
• The parent is responsible for safeguarding the PIN and the device.

4. Subscriptions, billing, and refunds

• HeyFriend Premium is available as a monthly or annual auto-renewing subscription. The annual plan includes a 3-day free trial; the monthly plan does not include a free trial.
• Live pricing is displayed inside the App on the trial/paywall screen and reflects current App Store prices in your local currency. Prices may vary by region and may change.
• Payment is charged to your Apple ID when you confirm the purchase. For trial plans, the charge occurs at the end of the trial unless cancelled at least 24 hours before it ends.
• Subscriptions auto-renew for the same term at the then-current price unless cancelled at least 24 hours before the end of the current period.
• Manage or cancel your subscription in iPhone Settings > [Your Name] > Subscriptions.
• Refunds are handled by Apple in accordance with Apple's refund policy. We are not able to issue refunds directly.

5. Acceptable use

You agree not to, and not to allow your child to, use the App to:

• Reverse-engineer, decompile, or attempt to extract the source code of the App.
• Interfere with, overload, or disrupt the App's infrastructure.
• Attempt to elicit content that violates applicable law or harms others.
• Use the App in a way that infringes intellectual property or other rights.
• Submit content (via voice or otherwise) that you do not have the right to submit.
• Share or distribute API keys, voice recordings, or generated content for unauthorized resale.

We may suspend or terminate access to the App if these Terms are violated.

6. AI-generated content

• The characters' replies are generated by AI in real time and are not pre-scripted. Replies may occasionally contain inaccuracies, unexpected statements, or content that does not match the character's intended persona.
• We continuously tune the prompts and apply safety guardrails to keep replies age-appropriate. If you encounter content you consider inappropriate, please email support@heyfriend.app with the date and time of the call so we can investigate.
• AI-generated content is provided "as is" — we do not warrant it is accurate, complete, or suitable for any particular purpose.

7. Voice, audio, and data

Microphone audio is processed in real time to generate the character's reply and is not stored on our servers. See the Privacy Policy for details on what is collected and how it is used.

You grant us a limited, non-exclusive, royalty-free license to process the audio and transcripts solely for the purpose of operating the App for you. We do not use this data to train AI models, to advertise, or for any other purpose.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total aggregate liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or USD $50, whichever is greater.

10. Termination

• You may delete the App and all on-device data at any time through Settings → Delete profile & all data, or by uninstalling the App.
• We may suspend or terminate access if these Terms are violated or if required by law.
• Sections that by their nature should survive termination (including 4, 7, 8, 9, 11, and 12) will survive.

11. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the App shall be resolved in the courts of the State of Delaware. If you are a consumer resident in the European Union, this clause does not deprive you of any mandatory protections of the law of your country of residence.

12. Changes to these Terms

We may modify these Terms from time to time. Material changes will be announced inside the App and on this page. Continued use of the App after a change constitutes acceptance of the updated Terms.
